La ponderación delimitadora de los derechos humanos: libertad informativa e intimidad personal

Abstract

If every right menas limited freedom, the human rights, as rights themselves, are also limited. This limitation must be dealt not from the legal normativism point of view, buy from the juridical positiveness, meaning truth to be done. More than existing extinsic limits, the judge, in the fair solution, must ponder the intrinsic game of the liberty-equality principles, which act as determinants of the human rights.

Author Biography

Andrés Ollero

Catedrático de Filosofía del Derecho en la Universidad de Granada, España. Autor de más de noventa publicaciones, su amplia labor como investigador y como escritor está dedicada al estudio de fundamento de los derechos humanos y de las vicisitudes de su producción.

 

Fue Diputado por Granada, centró su actividad, como palamentario, en los problemas de Educación y cultura, de cuya Comisión en el Congreso de los Diputados fue Vicepresidente. Adscrito también a la Comisión de Justicia, fue uno de los prtavoces en el debate sobre la eutanasia, con motivo del proyecto de reforma del Código Penal.
