Abstract

The author analyses some problems which are worth a dialogue with the ones who defend the thesisof the non-juridicity of the family In her opinion, the family is the place of the right itself, or the atmosphere which gives rise to a full capacity of people to offer themselves to others. Without the juridicity of the family, there is no possible understanding of the juridicity of the individual. Regarding the so-called "new family models", she states they are structurally based on anthropologic radicals of the familiarity, but their link doesn't provide them a total similarity with the nuclear family. For this reason, those family relations should be promoted and regulated legally, taking into account their identity and contribution to the society articulation : these relations should outstand legally from other types of social relations.

Ilva Myriam Hoyos Castañeda

Doctora en Derecho por la Universidad de Navarra y doctora en Jurisprudencia por el Colegio Mayor de Nuestra Señora del Rosario. Ha sido decana de la Facultad de Derecho y directora del Instituto de Humanidades de la Universidad de La Sabana. Entre sus publicaciones se mencionan: La libertad religiosa en la Constitución de 1991 (1993), El concepto de persona y los derechos humanos (1991), El concepto jurídico de persona (1988) y ¡uan Pablo lia los jóvenes (1986). Miembro de la Asociación Colombiana de Derecho Constitucional y Ciencia Política, del Instituto Phoenix, de la Bibliothéque de Philosophie Comparée, de la Corporación Centro de Estudios Constitucionales, Éticos y Políticos, de la Comisión de Bioética y Biojurídica de la Conferencia Episcopal de Colombia, y de la Academia Colombiana de Jurisprudencia.
