Abstract

Freedom does not belong to the order of naltural inclinations but to the order of being because it is the tendency or disposition of man toward perfection. It is not that freedom finds itself sense and plenitude. It is instead and onlological dimension of the himan being. The choice of evil is only possible as a distortion of freedom. The limit of freedom is human dignity or the eminence of being which in turn presupposes an "ought to be". Freedom is freedom for good. Dignity is not neutral. It is a valuation criterion referred to the eminence of man's goodness. The person is a demanding creature. In certain aspects he must be. The "ought to be" is the good that  constitudes the perfection or realization of man. Human dignity is, consequently, objetive criterion of goodness and od the lawfulness of his acts in relation with himself and with others.

Author Biography

Javier Hervada

Cursó la Licenciatura en Derecho en la Universidad de Barcelona. Doctor en Derecho de la Universidad Central de Madrid, actualmente, Universidad Complutense. Doctor en Derecho Canónico de la Universidad de Navarra. Por oposición obtuvo la plaza de Catedrático de Derecho Canónico de la Universidad de Zaragoza. Actualmente, por disposición legal pertenece al escalafón de Catedráticos de Derecho Eclesiástico del Estado de las Universidades públicas en la situación administrativa de Supernumerario. Ha sido decano de la Facultad de Derecho de la Universidad de Navarra y Director del Instituto de Derechos Humanos de la misma Universidad. Su obra investigadora y docente se ha centrado en temas de Derecho Canónico de Derecho matrimonial, de Derecho natural, de Derechos humanos, de Filosofía del Derecho y de Derecho Eclesiástico del Estado. Entre sus obras resaltamos: El derecho del pueblo de Dios, Escritos de derecho natural, lecciones propedéuticas de filosofía del derecho, Introducción crítica al derecho natural, Pensamiento sobre la sociedad plural y dimensión religiosa.
